CineX-AI Terms of Service

1. About CineX-AI

CineX-AI is a discovery and community platform focused on AI-generated and AI-assisted cinema. The Platform may allow filmmakers, creators, industry professionals, and audiences to create profiles, discover films and creators, submit information about creative works, upload or link to promotional materials, and participate in other CineX-AI features.

Features may be added, modified, suspended, or discontinued as the Platform develops.

2. Eligibility

You must be at least 18 years old to create a CineX-AI account unless CineX-AI expressly provides a service intended for younger users with appropriate consent procedures.

By creating an account, you represent that the information you provide is accurate and that you have the legal capacity to agree to these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You agree to provide accurate information and keep your account information reasonably current.

You may not impersonate another person or organization, create an account using information you do not have permission to use, or misrepresent your identity or professional affiliations.

CineX-AI may suspend or terminate accounts that violate these Terms or create legal, security, or safety risks for the Platform or its users.

4. Creator Content

“Creator Content” means films, videos, trailers, teasers, images, artwork, posters, descriptions, credits, biographies, audio, links, metadata, and other materials that you submit, upload, post, or otherwise make available through CineX-AI.

You Retain Ownership

CineX-AI does not claim ownership of your Creator Content.

As between you and CineX-AI, you retain your ownership rights in the original content you submit, subject to any rights belonging to third parties.

Permission You Give CineX-AI

By submitting Creator Content, you grant CineX-AI a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit, and make your Creator Content available as reasonably necessary to operate the Platform.

You also authorize CineX-AI to use and display submitted promotional materials, such as film titles, posters, stills, trailers, creator names, thumbnails, and descriptions, for the purpose of promoting the Platform, its creators, its catalog, and the availability of your work on CineX-AI.

This license does not transfer ownership of your Creator Content to CineX-AI.

To the extent reasonably practicable, CineX-AI will stop using Creator Content following its removal from the Platform, except where retention is legally required, technically necessary for backups or security, or necessary to resolve disputes or enforce these Terms.

5. Your Responsibility for Submitted Content

By submitting Creator Content, you represent that:

• you own the content or have the rights, licenses, permissions, and consents necessary to submit it;
• your submission does not knowingly infringe another person's copyright, trademark, privacy, publicity, contractual, or other legal rights;
• you have obtained appropriate permissions for third-party music, performances, images, footage, trademarks, likenesses, or other protected material where required; and
• you have the authority to grant CineX-AI the permissions described in these Terms.

You remain responsible for your Creator Content.

6. AI-Generated and AI-Assisted Content

CineX-AI is designed in part to showcase work created using artificial intelligence.

Creators are responsible for ensuring that their use of AI tools and the resulting content complies with applicable law and with any licenses or terms governing the AI tools, datasets, media, or other materials they use.

CineX-AI may request information regarding how AI was used in the creation of submitted work and may establish labeling, disclosure, eligibility, or classification requirements for AI-generated or AI-assisted content.

A work's presence on CineX-AI does not constitute a determination by CineX-AI regarding copyrightability, ownership, authorship, legality, or eligibility for copyright protection.

7. Prohibited Content and Conduct

You may not use CineX-AI to:

• upload material you do not have the right to share;
• impersonate another creator or organization;
• knowingly provide materially false credits or information;
• distribute malware or malicious code;
• attempt to interfere with or gain unauthorized access to the Platform;
• scrape, harvest, or systematically extract Platform data except where authorized by CineX-AI or permitted by applicable law;
• use the Platform to violate applicable law; or
• engage in harassment, threats, exploitation, fraud, or other unlawful conduct.

CineX-AI may remove content or restrict accounts when reasonably necessary to enforce these Terms.

8. Intellectual Property of CineX-AI

Except for Creator Content and third-party materials, CineX-AI and its licensors own the Platform and its associated software, design, branding, graphics, databases, interfaces, trademarks, logos, and other proprietary materials.

Nothing in these Terms grants users ownership of CineX-AI intellectual property.

You may not reproduce, distribute, sell, license, reverse engineer, or commercially exploit protected elements of the Platform except as permitted by law or with written authorization.

9. Copyright Complaints

CineX-AI respects intellectual-property rights.

If you believe content available through CineX-AI infringes your copyright or other intellectual-property rights, you may submit a complaint to:

Your notice should identify the protected work, identify the allegedly infringing material, provide your contact information, and include any statements or information required by applicable law.

CineX-AI may remove or restrict access to disputed material while reviewing a complaint.

Where applicable, CineX-AI may maintain procedures consistent with the U.S. Digital Millennium Copyright Act (“DMCA”).

10. Discovery and Professional Opportunities

CineX-AI may help users discover creators, films, festivals, companies, opportunities, or other industry information.

However, CineX-AI does not guarantee:

• employment;
• representation;
• financing or investment;
• distribution or acquisition;
• festival acceptance;
• awards or nominations;
• audience size;
• revenue;
• professional contacts; or
• commercial success.

Unless expressly stated otherwise, listings, rankings, recommendations, or discovery features do not constitute endorsements.

11. Third-Party Services

CineX-AI may contain links to or integrations with third-party websites, streaming platforms, AI tools, social networks, payment processors, or other services.

Those services are governed by their own terms and privacy practices. CineX-AI is not responsible for third-party services outside its reasonable control.

12. Paid Services

CineX-AI may offer paid subscriptions, memberships, promotional services, events, or other paid features.

Pricing, billing frequency, renewal terms, cancellation rules, and refund policies applicable to a purchase will be disclosed before purchase.

Additional terms may apply to specific paid services.

13. Beta and Experimental Features

Certain CineX-AI features may be identified as beta, preview, experimental, or early-access services.

Such features may contain errors, change substantially, experience interruptions, or be discontinued.

Users should not rely on beta features as permanent functionality.

14. Platform Availability

We aim to provide a reliable service but cannot guarantee uninterrupted or error-free access.

CineX-AI may perform maintenance, introduce new functionality, modify existing features, or temporarily restrict access where reasonably necessary.

15. Suspension and Termination

CineX-AI may suspend or terminate access when a user materially violates these Terms, threatens the security or integrity of the Platform, exposes CineX-AI or others to legal risk, or engages in unlawful activity.

Users may stop using CineX-AI and may request account deletion subject to applicable retention requirements.

16. Disclaimers

To the fullest extent permitted by applicable law, CineX-AI is provided on an “as is” and “as available” basis.

CineX-AI does not warrant that every listing, user submission, credit, description, AI classification, or third-party piece of information will be complete, accurate, or current.

Nothing provided through the Platform constitutes legal, financial, investment, or professional representation advice.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, CineX-AI and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform.

Any limitation of liability will apply only to the extent permitted by applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless CineX-AI and its affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Platform, your Creator Content, your violation of these Terms, or your infringement of another person's rights.

19. Changes to These Terms

CineX-AI may update these Terms as the Platform evolves or legal requirements change.

When material changes are made, we will provide reasonable notice where required. The updated Terms will display a revised effective date.

20. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, except where mandatory consumer-protection laws provide otherwise.
